1. Qualifying Persons

1.1 PrizeHeist contests (‘PH’, 'Promoter', 'our(s)') operate contests – skilled prize contests resulting in the allocation of prizes in accordance with these Terms and Conditions on the website www.prizeheist.com (the 'Website') - (the 'contest(s)').

1.2 The contests are open to all persons aged 18 and over and the age of majority in their country of residence excluding the Promoter's employees or members of their immediate family, agents or any other person who is connected with the creation or administration of our contests.

1.3 The promoter reserves the right at their own discretion to close a customer’s account or the right to refuse a customer’s entry to a contest any time, if they feel the Customer is exploiting the services or they believe that it is not genuinely the Customer that is entering.

2. Legal Undertaking

2.1 By entering a contest, the entrant ('Entrant', 'you', 'your(s)') will be deemed to have legal capacity to do so, you will have read and understood these Terms and Conditions and you will be bound by them and by any other requirements set out in any related promotional material.

2.2 Governing laws: These Terms shall be governed, interpreted, and construed in accordance with the laws of India, without regard to the conflict of law provisions and for resolution of any dispute arising out of your use of the Services or in relation to these Terms. Notwithstanding the foregoing, you agree that (i) Flipkart has the right to bring any proceedings before any court/forum of competent jurisdiction and you irrevocably submit to the jurisdiction of such courts or forum; and (ii) any proceeding brought by you shall be exclusively before the courts in Kerala, India.

2.3 In the event that you participate in a contest online via the Website, and by accepting these Terms and Conditions you confirm that you are not breaking any laws in your country of residence regarding the legality of entering our contests. The Promoter will not be held responsible for any Entrant entering any of our contests unlawfully. If in any doubt you should immediately leave the Website and check with the relevant authorities in your country.

3. Contest Entry

3.1 These contests may be entered online via the Website. Multiple contests may be opened at the same time by the Promoter of which each contest will have specific prizes.

3.2 An entrant may enter multiple contests with a number of entries capped or defined by the promoter.

3.3 Availability and pricing of contests and tickets is at the discretion of the Promoter and will be specified on the Website.

4. Your Prize Heist Account

4.1 In order to enter a contest, you will need to register an account with us. You can register an account online at www.prizeheist.com

4.2 To register an account online you will be asked to provide an email address or phone number.

4.3 Please note that your email address or Social Media Account will also be the username that you use to login to your account. Each account can only have one username attributed to

it at any given time ("PrizeHeist Account"). Therefore, you cannot attribute multiple email addresses, or Social Media Accounts to your PrizeHeist Account. For example:

(i) You cannot have an email address and a Social Media Account attributed to your PrizeHeist Account.

(ii) You cannot have two or more email addresses attributed to your PrizeHeist Account. You can, however, change your username for your PrizeHeist Account by logging into your PrizeHeist Account. For example, you can create your PrizeHeist Account using one email address and later change your username for your PrizeHeist Account to another email address. However, if you create multiple accounts using different email addresses or Social Media Accounts, each username will be treated as a separate PrizeHeist Account.

4.4 When playing a contest online via the Website, follow the on-screen instructions to

I. Select the contest(s) you wish to enter and play the quiz (s)

II. When you are ready, note the capping of Tickets(s) you can purchase, provide your contact and payment details. You will need to check your details carefully.

III. Once your payment has been cleared, we will email you to confirm your entry into the contest. Please note that when entering online you will not be deemed entered into the contest until we confirm Your Ticket(s) order back to you by email.

4.5 The Promoter reserves the right to refuse or disqualify any incomplete Entries if it has reasonable grounds for believing that an Entrant has contravened any of these Terms and Conditions.

4.6 To the extent permitted by applicable law, all Entries become our property and will not be returned.

5. The Heist Club

5.1 A Heist Club subscription costs the amount set out on the Website, this may change from time to time at the Promoters discretion, and if you would like to purchase a Heist Club subscription, you can do so through the Website.

5.2 If your Heist Club subscription should be cancelled for any reason your new subscription cost will be decided by the promoters at their discretion.

6. Heist Club Requirements

6.1 The Promoter reserves the right to refuse a registration for any reason whatsoever at it s sole and absolute discretion (including, without limitation, a person applying to become a Heist Club member not satisfying the requirements set out in rule 6.2 below).

6.2 A person applying to become a Heist Club member must satisfy the following requirements:

I. The person’s monetary transactions must come from an authorized bank.

II. The person must be 18 or over.

III. Must supply their payment app/UPI/credit/debit card details which must be linked to a bank account or financial institution for which they are an authorized account holder and must also be linked to their home address. This bank or any legitimate and authorized financial account must not be a joint account and must be held in the applicant’s own name.

IV. Any mode of payments stated above (6.2.3) must not have been reported as lost or stolen or unauthorized for any reasons by the governing bank or financial institution's discretion; and cannot be used to open any more than one Heist Club member account; and

V. Any mode of payments stated in (6.2.3) must have the applicant’s name and match the

applicant’s details supplied including (without limitation) the applicant’s billing address etc.

6.3 By signing up for a Heist Club subscription, you hereby authorize the Promoter to collect payment of the subscription fee from your nominated bank account until this authorization is revoked. Subscription payments will be taken from the nominated bank account on a monthly basis. Collected payments from your nominated bank account entitle you to enter into the applicable upcoming monthly competition following the collected payment.

6.4 When signing up for a Heist Club subscription, you will need to provide the Promoter with valid payment details including, where appropriate, your instruction to a nominated bank to pay the subscription fee by ACH Mandate. You can cancel your subscription by visiting the “Your Account” section on the website.

6.5 You must keep the information and details (including, without limitation payment details) you provide to us current and up to date throughout the duration of your Heist Club membership.

7.  Heist Club Payments

7.1 At the point of signing up, you will be informed when the first payment of the subscription fee will be taken, which may be immediately. Thereafter, the first attempt to obtain payment each month will be on the date you signed up, unless otherwise communicated to you by the Promoter. It is your responsibility to ensure that there are sufficient funds in your nominated bank account on the applicable date. If there are insufficient funds, your nominated bank may impose a penalty charge for the collection and the Promoter may be unable to collect payment and you will not be able to enter applicable upcoming monthly competitions and enjoy Heist club benefits. The Promoter is not responsible for additional transaction charges imposed on you by your nominated bank.

7.2 The Promoter accepts no responsibility and will have no liability for any act or omission of any bank chargebacks, disputes, indemnities and/or failures to implement ACH Mandate or otherwise to act on your instructions.

7.3 If the Promoter is unable to collect your payment on the applicable collection date you will not be entered into a month’s Heist/competition unless the Promoter has received all amounts payable for the subscription in cleared funds for that month.

The Promoter accepts no responsibility and will have no liability for any loss and/or damage caused as a result of you not being entered into a month’s Heist/Competition in circumstances where the Promoter has sought payment from your nominated bank account and the nominated bank did not make payment.

7.4 Any change to the details provided to the Promoter during registration should be made under the “Your Account” section of the website. If you wish to change the nominated bank specified in your registration, you will need to complete a new ACH mandate.

7.5 You can terminate your subscription at any time by visiting the “Your Account” section of the website. The Promoter reserves the right to terminate or suspend a monthly subscription at any time and for any reason whatsoever at its sole and absolute discretion (although this will not affect the results of any monthly competition that you have been entered into).

 8.  Refer a Friend Program

8.1 The Refer a Friend Program is operated in good faith to reward customers for referring genuine friends and acquaintances as new customers to the Promoter. Referrals are limited to 100 per customer per day. Abuse of this system will not be tolerated if the Promoter. 

has reasonable grounds to believe that new users are not genuine individuals. It reserves the right at its sole discretion to void any orders and/or Heist Coins earned as a result of the scheme, and to disqualify such individuals as a Prize Winner.

8.2 The referee must be a registered PrizeHeist club member and for each successful referral they (referee and referred) will receive 50 credits each 7 days after the referred joins and does not cancel their membership.

8.3 The referred will receive their additional 50 credits after their second payment is taken.

8.4 The same person cannot be referred to more than once.

9. Contest Periods

9.1 Each contest will run for a specified period. Please see each contest for details of start and end times and dates ('contest Period(s)').

10. The Contest

10.1 How to enter.

I. Each contest will run from including the opening and closing dates specified on the website. These dates shall be referred to as the “opening date” &/or the “closing date” of a contest.

II. If it is necessary to do so, the promoter reserves the right to change the opening & closing dates. If the promoter does change the opening date &/or the closing date of a contest, the new details will be displayed on the website.

III. All contest entries must be received by the Promoter by no later than the specified time on the closing date. All entries received after the specified time on the closing date are automatically disqualified.

IV. The maximum number of entries to the contest will be stated on the website. The number of entries you can make may be limited if the maximum number of entries is reached.

10.2 How to enter The Contest.

  • Log into your account on www.prizeheist.com
  • Click on the “Contest” tab.
  • Select the prize you want to play for
  • Answer the questions in the least amount of time.
  • Select the number of tickets you want & add to basket.
  • Click “checkout”
  • Complete your purchase.

11. Winners 

11.2 All entries will be assigned a random number between 1 and the maximum range for that competition.

11.3 Entrants are required to answer the questions correctly. Every competition will have a different set of questions/ and level of difficulty.

11.4 The winner will be determined by evaluating the maximum number of answers given correctly in the least amount of time. 

For example1: Participant A answered 6 correct answers out of 10 in 1 minute, Participant B answered 6 correct answers in 50 seconds. In this example Participant B wins. 

Example2: Participant A answered 8 correct answers out of 10 in 3 minutes, Participant B answered 9 out of 10 answers correctly in 5 minutes. In this Participant B wins.

11.5 Promoters will announce the winner of each competition on their Social Media accounts and contact the winner directly via email, phone, or SMS.

11.6 If for any reason the Promoter is unable to contact a Winner within 5 days (which may be extended at the sole discretion of the Promoter) of the end of a Competition or the Winner fails to confirm acceptance of the prize or the Winner is disqualified as a result of contravening any of these Terms and Conditions, the Winner will forfeit the prize and the prize maybe given to the participant who came second OR the competition will be reorganized. We Reserve the right to add a cash alternative at any time during a live competition. It is up to the winner whether they choose this or the prize.

11.7 The Promoter reserves the right at its sole discretion to extend the closing date of any competition, if for any reason any aspect of the competition is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorized intervention, fraud, technical failures or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Competition. The Promoter may in its sole discretion cancel, terminate, modify or suspend a Competition, or invalidate any affected entries. In the event that the Promoter closes a Competition early, the Winner may be selected from all valid and eligible Entries received by the Promoter prior to the date of closure, except that the Promoter reserves the right, at its sole discretion, to close a Competition early without selecting a Winner. In the event that a Competition is closed without reaching the maximum entries, the Competition will take place regardless and the winner will be given 75% as credit (Heist Coins) of the total number of entries received. The Promoter will give a refund ONLY in the form of Heist Coins. Refunds will be initiated immediately and will reflect in your account within 3 days.

11.8 All Entrants are automatically entered onto the Promoter’s database for the purpose of conveying information as to the status of their Competition, as well as any future Promotions or Competitions offered by the Promoter.

12: Winner’s Details

12.1 All Winners will also be required to provide photographs and/or pose for photographs and videos, which may be used in future marketing and public relations by the Promoter in connection with the Competition and identifying them as a winner of a Competition.

12.2 The Winners will be required to send a copy of their passport, driving license or any Valid Govt ID to the Promoter to confirm their identity, age and also to prove that if the purchase was made by credit card that the card was legally theirs or that they had authorization to use it before any prize will be paid or delivered. Any failure to meet these obligations may result in the Winner being disqualified and the Promoter choosing an alternate winner.

12.3 Following receipt and verification of the details requested above by the Promoter, the Winners will be contacted in order to make arrangements for delivery of the prize.

12.4 Surprise Contact Details: On your account page you have the option to add the contact details of an individual who we can contact to help arrange the surprise if you are a Winner. (For Ex: If you are the winner, you can arrange the prize to be delivered to another person as a surprise gift) We will categorically not share or pass these details on to any third party but in adding them you are confirming that you have the consent from the person to pass these details to PrizeHeist. 13. Competition Prizes

13.1 The Competitions consist of many different prizes. For the avoidance of doubt, there will be only one prize awarded for each Competition.

13.2 The prize details will be clearly displayed on the webpage.

13.3 All Prizes are subject to the Terms and Conditions of the prize provider, manufacturer or supplier.

 13.4 Each Prize must be accepted as awarded and is non-transferable or convertible to other substitutes and cannot be used in conjunction with any other vouchers, offers or discounts, including without limitation to any vouchers or offers of the Promoter or other prize suppliers. All prizes are sold as seen. Any warranty is as advertised.

13.5 The promoter does not take responsibility for any manufacturing or after-sales defects. Any warranty/service or product related grievances should be dealt with/by the manufacturer directly.

14. Winners’ Personal Data

14.1 Acceptance of the prize by the Winner will mean they are required to have their photo and video taken by the Promoter for promotional purposes (Public Relations and Marketing), both immediately after their win and in the future for use.

14.2 By entering a Competition, you agree to the use of your name, address, and/or photograph or other likeness, as well as your appearance at publicity events without any additional compensation (for reasonable travel expenses) and as required by the Promoter if you are declared a Winner.

15. Limits of Liability

15.1 The Promoter makes no representations or warranties as to the quality/suitability of any of the goods or services offered as prizes. The Promoter shall not be liable for any loss suffered or sustained to person or property including, but not limited to, consequential (including economic) loss by reason of any act or omission by the Promoter, or its servants or agents, in connection with the arrangement for supply, or the supply, of any goods by any person to the prize Winner(s) and, where applicable, to any family/persons accompanying the Winner(s), or in connection with any of the Competitions promoted by the Promoter.

16. Electronic Communications

16.1 No responsibility will be accepted for failed, partial or garbled computer transmissions, for any computer, telephone, cable, network, electronic or internet hardware or software malfunctions, failures, connections, availability, for the acts or omissions of any service provider, internet accessibility or availability or for traffic congestion or unauthorized human act, including any errors or mistakes. The Promoter shall use its best endeavors to award the prize for a Competition to the correct Entrant. If due to reasons of hardware, software, or other computer related failure, or due to human error the prize is awarded incorrectly, the Promoter reserves the right to reclaim the Competition prize and award it to the correct Entrant, at its sole discretion and without admission of liability.

16.2 The Promoter reserves the right at its sole discretion to extend the closing date of any competition, if for any reason any aspect of the competition is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorized intervention, fraud, technical failures or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Competition.

 In the event that a Competition is closed without selecting a Winner, the Promoter will give all entrants PrizeHeist credit (Heist Coins) to enable them to replay equivalent tickets in a subsequent competition.

16.3 The Promoter shall not be liable for any economic or other consequential loss suffered or sustained to any person to whom an award has been incorrectly made, and no compensation shall be due.

The Promoter shall use its best endeavors to ensure that the software and website(s) used to operate its Competitions perform correctly and accurately across the latest versions of popular internet, tablet, and mobile browsers. For the avoidance of doubt, only the ticket coordinates recorded in our systems, however displayed, or calculated, shall be entered into the relevant Competition and the Promoter shall not be held liable for any competition entries that occur as a result of malfunctioning software or other event.

12. Data Protection Notice

12.1 Any personal data that you supply to the Promoter or authorize the Promoter to obtain from a third party, for example, a credit card company, will be used by the Promoter to administer the Competition and fulfil prizes where applicable. In order to process, record and use your personal data the Promoter may disclose it to

(i)         any credit card company whose name you give.

(ii)        any person to whom the Promoter proposes to transfer any of the Promoter’s rights and/or responsibilities under any agreement the Promoter may have with you.

(iii)       any person to whom the Promoter proposes to transfer its business or any part of it;

(iv)       comply with any legal or regulatory requirement of the Promoter in any country; and

(v)        prevent, detect, or prosecute fraud and other crime. In order to process, use, record and disclose your personal data the Promoter may need to transfer such information, in such event the Promoter is responsible for ensuring that your personal data continues to be adequately protected during the course of such transfer.
